Old Town of Broad Ripple Meeting Minutes #175

This historic serial has run on and off in the last 18 years of the Broad Ripple Gazette. The intention is to share the history of Broad Ripple, help people find their ancestors in the text, and to complete the transcriptions of these important early documents.
The Town of Broad Ripple was incorporated in 1894, and started holding regular meetings at that time. In each issue, I will print my transcription of the old Town of Broad Ripple meeting minutes. These are taken from the original, hand-written minutes that contain many spelling errors. I have transcribed all the records as they were entered, including errors. I will make some corrections to the text in brackets [ ]. I will try to include street name changes, such as: Morgan Street is now Guilford, North is now 64th, Hancock is now Westfield. Here is the one-hundred seventy-fifth installment

Improvement Resolution No. 3 (1905) [crossed out No. 2 1903)] adopted by the Board of Trustees of said Town, and the plans, profile, and specifications on file in the office of the Town Clerk of said Town, which said resolution, and said plans, profile, and specifications are made a part hereof as fully and effectually as if copied herein at full length. And also, (That said party of the first part covenants and agrees to improve the east side of Morgan Street from Shelby Street to 60th Street in said Town, by cementing the side-walk, grading the lawn and gutter for the sum of $.91 per lineal front foot complete according to the terms of Improvement Resolution No. 3 (1903), adopted by the Board of Trustees of said town, and the plans, profile, and specifications on file in the office of the Town Clerk of said Town which said Resolution and said plans, profiles, and specification are made a part hereof as fully and effectually as if copied herein at full length, and also,
That said party of the first part covenants and agrees to improve the west side of Hamilton Street from Coil Street north to Shelby Street in said Town, by cementing the side-walk, grading the lawn and gutter for the sum of $.93 per lineal front foot complete according to the terms of Improvement Resolution No. 4 (1903), adopted by the Board of Trustees of said town, and the plans, profile, and specifications on file in the office of the Town Clerk of said Town which said Resolution and said plans, profiles, and specification are made a part hereof as fully and effectually as if copied herein at full length,
The party of the first part further contracts and agrees that in the prosecution of said work all proper skill and care will be exercised; that said part will properly and fully guard and protect all excavations or dangerous places, and will use all due and proper precautions to prevent injury to any property, person or persons, what or whomsoever; that, for and during the time of the making of such improvement, and the period for which the same is to be maintained and kept in repair by the party of the first part, said Town of Broad Ripple shall be saved harmless from all and any liability what so ever growing out of any injury or damage to property or persons because of any neglect or fault of the said party of the first part, its agents or employees, in the execution of this contract, or any matter connected therewith or related therewith and to pay any judgement with costs, which may be obtained against said Town growing out of any such injury or damage. It is mutually understood and agreed that the said second party shall be liable to ____first part for the contract price of such improvements, whether represented by bonds or assessments, to the extent of the moneys actually received by said Town from assessments or bonds growing out of such improvements, and for no more.
