2006-UV1-039 6528 Ferguson Street (Approximate Address), Zoning District(s): D-4 (FF) Petitioner/Agent: James and Margaret Irsay, by Steven B. Granner, Request(s): VARIANCE OF USE of the Dwelling Districts Zoning Ordinance to provide for an exercise studio use (not permitted).

2006-APP-851 5401, 5411 AND 5425 NORTH COLLEGE AVENUE (Approximate Address) 2006-VAR-851 2006-VAC-851 KRG COLLEGE, LLC, by Thomas Michael Quinn requests Approval of MODIFICATION OF COMMITMENTS, related to petition 2005-ZON-811, to a) modify Commitment One to read as follows: "The site plan and elevations, file dated October 5, 2006 shall be substantially complied with, including at least five parking spaces having dimensions of ten (10') by eighteen (18') feet, and b) modify Commitment Twelve to read as follows: "Additional landscaping shall be in compliance with the site plan file dated October 5, 2006. VACATION of Air Rights above a portion of Bungalow Court, being five feet in width, between the elevations of 14 feet and 27 feet above grade, FROM a point on the east right-of-way line of North College Avenue, being the northwest corner of Lot Number six in College Avenue Heights, as recorded in Plat Book 16, Page 146 in the Office of the Marion County Recorder TO a point 216.68 feet to the east on the south right-of-way line of Bungalow Street, being the northeast corner of Lot Number 9 in College Avenue Heights, as recorded in Plat Book 16, Page 146 in the Office of the Marion County Recorder.

NOTE: descriptions in parenthesis such as, "not permitted" and "minimum ... required", are describing the current zoning for the property. The variance is being sought to deviate from those limitations.
