Zoning issues at BRVA August meeting

There were around 20 in attendance at the August 26, 2025, public meeting of the Broad Ripple Village Association [BRVA] Land Use and Development committee that was held in the basement of Northminster Presbyterian Church, 1660 Kessler Boulevard.

There were four items on the agenda, in bold below.

6434 N. College Ave. - BR Rentals LLC: LUD Chair Bo Boroski will provide an update on the progress of this project provided by the property owner
There was a brief update on the office building at 6434 N. College Avenue. The interior demolition is almost complete. The search for new tenants will start soon.

5907 Birchwood Avenue - Drew T & Taylor M Gaynor: Justin Kingen, David Kingen and Kaitlin Mennenga with NDZA, Inc., presenting on a request for a Variance of Development Standards of the Consolidated Zoning and Subdivision Ordinance to provide for a building addition with an eight-foot rear yard setback (20 feet required). Case #2025-DV2-029 - Hearing scheduled for September 9, 2025
This request is to raze a small garage on the property and construct a new 2-car garage. The new garage will be 8 feet from the rear property line and requires a variance of development standards from the City.
The committee voted to support this project.

157 E 61st Street - Julie Moeller: Julie Moeller will be presenting on a request for a Variance of Development Standards of the Consolidated Zoning and Subdivision Ordinance to provide for a building addition resulting in an 11-foot rear yard setback (20 feet required). Case #2025-DV2-030 - Hearing scheduled for September 6, 2025
This is a similar setback issue. The house is expanding to go from a 1 bath 2 bedroom to a 2 bath 3 bedroom and requires a variance for the rear yard setback requirement.
The committee voted to support this project.

6290 N. College Avenue - Obscure Investors LLC: Joseph Calderon with Barnes & Thornburg, presenting on a request to rezone .42-acre from the D-7 (FF) (TOD) district to the C-3 (FF) (TOD) district to provide for neighborhood commercial uses, and also on a request for a Variance of Development Standards of the Consolidated Zoning and Subdivision Ordinance to legally establish the existing surface parking lot partially within the College Avenue right-of-way and partially within the Canal right-of-way (not permitted), and to provide for 18 parking spaces (minimum one parking space for every 300 square feet of building area, or 27 spaces required).
The potential buyer of the CVS property, not the store itself, wants to change from the existing variance (from 1964) for a drug store at this location to a rezoning to allow for a limited list of other uses. The BRVA and the petitioner worked out the list of excluded uses. There are no changes planned for the property.

A neighbor asked that the new owner remove the parking lot extension that protrudes into the Central Canal, adding a driveway on the south side of the store and 5 parking spots. That piece of the Canal was purchased from Citizens (the owner of the Canal) in 1994 by the current property owner Real Estate Corporation of America.
It was explained that no changes can be made to the site without approval from CVS.
The committee voted to support this project.

The next public meeting of the committee is scheduled for Tuesday, September 23, 2025, at 6pm, at Northminster Presbyterian Church.
