Old Town of Broad Ripple Meeting Minutes #160

The Town of Broad Ripple was incorporated in 1894, and started holding regular meetings at that time. In each issue, I will print my transcription of the old Town of Broad Ripple meeting minutes. These are taken from the original, hand-written minutes that contain many spelling errors. I have transcribed all the records as they were entered, including errors. I will make some corrections to the text in brackets [ ]. The original minutes books are at the Indiana State Archives at 6440 E. 30th St.

Here is the one-hundred sixtieth installment:
From 1903, the last parts of the supplemental ordinance for the traction company ordinance. Then, the ballot for the 1903 town election.

SECTION 5.
If the grantee, its successors and assigns, shall be unable to furnish the service herein before provided for any reason of accidents, strikes, act of God, or other cause beyond it's control, it shall not be liable therefor.

SECTION 6
This ordinance shall be void unless accepted by the grantee, it's successors or assignees within thirty (30) days from this date

SECTION 7
An emergency is declared to exist for the immediate taking effect of this ordinance, which shall be in full force and effect from and after its passage. Adopted this 27th day of April 1903

This indenture witnesseth that the Indianapolis Northern Traction Company, a corporation organized under the laws of the State of Indiana, hereby accept the ordinance adopted and franchise and contract granted by the Board of Trustees of the Town of Broad Ripple, Marion County, Indiana, on the 27th day of April, 1903, entitled:
"An ordinance supplemental to an ordinance adopted by the Board of Trustees of the town of Broad Ripple, Marion County, Indiana, on the third day of April, 1903, entitled: "AN ORDINANCE granting to INDIANAPOLIS NORTHERN TRACTION COMPANY, its successors and assigns, authority to construct, maintain and operate an interurban street railroad over, upon and along certain streets of the Town of Broad Ripple, in the County of Marion, and State of Indiana", and all of the rights, privileges and franchises granted by said ordinance.
In witness whereof, said Indianapolis Northern Traction Company has caused its corporate name to be signed and its corporate seal to be attached hereto, by its President, and attested by its Secretary, this 28th day of April, 1903

The Board of Trustees of the Town of Broad Ripple met in regular session.
All members present.
The minutes of the last regular and ____ Call meetings read and approved except the minutes of Apr 27th which were approved Apr 29th. The following bills were read and in motion were allowed and order drawn on the Treasurer for the inspection amount.

As per the election returns of the regular Town Election held on the Fourth Day of May 1903. And the said Election Board also certified to the notification of the franchise granted the Indianapolis Northern Traction Company which was also voted on at the said Town Election (sample ballot pasted on opposite page.)
The Board instructed the Marshall to see that the Water Works Co did not put up a fence along the Westfield Gravel Road north of the Canal on the east side of said road. The Marshall was also instructed to repair the road at the Canal Bridge at Morgan Street. On regular motion the Board adjourned to meet in special session Saturday PM to swear in the new Town Officers and allow bills.
