Old Town of Broad Ripple Meeting Minutes #158

The Town of Broad Ripple was incorporated in 1894, and started holding regular meetings at that time. In each issue, I will print my transcription of the old Town of Broad Ripple meeting minutes. These are taken from the original, hand-written minutes that contain many spelling errors. I have transcribed all the records as they were entered, including errors. I will make some corrections to the text in brackets [ ]. The original minutes books are at the Indiana State Archives at 6440 E. 30th St.

Here is the one-hundred fifty-eighth installment:
From 1903, a supplemental ordinance for the traction company ordinance.

This Indenture Witnesseth that Indianapolis Northern Traction Company, a corporation organized under the laws of the State of Indiana hereby accepts the ordinance adopted by Board of Trustees of the town of Broad Ripple, in the county of Marion, and State of Indiana on the third day of April 1903 entitled,----
"AN ORDINANCE granting to INDIANAPOLIS NORTHERN TRACTION COMPANY, its successors and assigns, authority to construct, maintain and operate an interurban street railroad over, upon and along certain streets of the Town of Broad Ripple, in the County of Marion, and State of Indiana." And all of the rights and privileges and franchises granted by said ordinance.
In Witness Whereof, said Indianapolis Northern Traction Company has caused its corporate name to be signed and its corporate seal to be attached hereto, by its President and attested by its Secretary, this fourth day of April, 1903.

An ordinance supplemental at an ordinance adopted by the Board of Trustees of Broad Ripple, Marion, Indiana, on the third day of April 1903, entitled. "AN ORDINANCE granting to INDIANAPOLIS NORTHERN TRACTION COMPANY, its successors and assigns, authority to construct, maintain and operate an interurban street railroad over, upon and along certain streets of the Town of Broad Ripple, in the County of Marion, and State of Indiana."

SECTION 1.
BE IT ORDAINED by the Board of Trustees of the Town of Broad Ripple, in the County Of Marion, and State of Indiana, that consent, permission and authority be and hereby are granted unto Indianapolis Northern Traction company, its successors and assigns, hereinafter in this ordinance designated as "Grantee", to survey, locate, construct, maintain and operate a single or double track standard gauge street and interurban railroad, with the necessary side-tracks, switches, turn-outs and turn-tables, and to locate, construct, maintain and use all mechanical appliances and contrivances necessary and suitable to operate the same, including the use of electricity as a motive power by the overhead trolley system, or such other system as the Grantee, its successors and assigns, may select, in, upon, along and over the following streets in said town, to-wit:
So much of Shelby Street as lies within the corporate limits of said town of Broad Ripple from the intersection of said Shelby Street and Light Avenue. East to the entrance to the park of the
Of the Broad Ripple Traction Company, and within such park. Also, from the entrance to said park east on Shelby Street to the east corporate limits of said town with the right to connect said line by means of proper curves and other connections with the line of street and interurban railroad of the grantee to be constructed on said Light Avenue under this ordinance which this supplemental, and also with the right to diverge from said intersection of Shelby Street and Light Avenue to connect with the private right of way or property of the grantee, its successors and assigns.
This ordinance is supplemental to an ordinance adopted by the Board of Trustees of said town of Broad Ripple on the third day of April, 1903, entitled, "AN ORDINANCE granting to INDIANAPOLIS NORTHERN TRACTION COMPANY, its successors and assigns, authority to construct, maintain and operate an interurban street railroad over, upon and along certain streets of the Town of Broad Ripple, in the County of Marion, and State of Indiana."
And all grants made by said ordinance are subject to all the terms and conditions and carry all the rights and privileges, and are for the same term granted by said ordinance adopted April 3, 1903 except in so far as otherwise expressly provided in this ordinance.
The grantee, its successors and assigns, may in place of constructing a street railway over that part of its authorized routes covered by the lines of the Broad Ripple Traction Company may acquire from the Broad Ripple Traction Company its lines and systems of street railway in said town of Broad Ripple, and such lines and systems, if so required, shall be owned, maintained and operated subject to all of the terms and conditions and carry all the rights and privileges, and are for the same term granted by the original ordinance to which this is supplemental.
