Special December BRVA land use meeting held

The Broad Ripple Village Association (BRVA) called a special meeting of the Land Use and Development Committee on December 8 to discuss two petitions concerning the proposed parking garage/mixed-use structure to be built on the Marathon station and Marcos Pizza properties. The committee typically does not hold a December meeting.
Petition 2011-DV2-021 is a request for a zoning variance to allow for a drive-through bank in the garage without the required number of stacking spaces or a bypass lane, the relaxation of the flood ordinance to allow for the ground floor to be build below flood stage, and the relaxation of the parking space size requirement to allow for compact car spaces.
Petition 2011-VAC-008 is a request to give air and subterranean rights to the project to allow for underground structural building components to be installed in the public right of ways and for above ground components on the upper floors to extend into the right of ways.
The committee discussed these two petitions for over an hour. The vote was to oppose the petitions. The committee stated that this project has grown from the initial proposal that was accepted by the city. The retail space should be reduced allowing for a smaller footprint of the building. This could be done so as to not require any zoning variances for public right of way encroachment. The committee also stated that the project has not followed through with the language in the Request for Quotation as originally submitted. The main points the committee mentioned included the drive-though lane and the Westfield Boulevard setbacks and sidewalk widths.
The Metropolitan Board of Zoning Appeals hearing for 2011-DV2-021 was held on December 13, 2010. That board heard the testimony from the petitioners and from the remonstrators and voted unanimously to approve the variances.
The hearing for the 2011-VAC-008 is scheduled for January 14, 2011, before the Plat Committee in the City-County Building.
The next BRVA Land Use public meeting is scheduled for January 24, 2011, 6pm, at Broad Ripple United Methodist Church.
