Old Town of Broad Ripple Meeting Minutes #122

The Town of Broad Ripple was incorporated in 1894, and started holding regular meetings at that time. In each issue, I will print my transcription of the old Town of Broad Ripple meeting minutes. These are taken from the original, hand-written minutes that contain many spelling errors. I have transcribed all the records as they were entered, including errors. I will make some corrections to the text in brackets [ ]. The original minutes books are at the Indiana State Archives at 6440 E. 30th St.

Here is the one hundred twenty-second installment:

ordinance requiring the RR to install and maintain lights at crossings

Broad Ripple Ind Nov. 5th 1901
Board met in regular session all members present. Minutes of Oct 11 read and approved.
The following bills were allowed.

The following Ordinance was read and on motion of C.W. Silvey was adopted and the clerk ordered to post copies of same.
An Ordinance requiring the Chicago, Indianapolis and Louisville Railway Company to erect and maintain lamps and lights at the intersection of its track with Shelby Street [now called Broad Ripple Avenue], Hancock Street [now Westfield Boulevard], North Street [now 64th Street] and North Main Street [now 65th Street] in the Town of Broad Ripple, Marion County, Indiana. And declaring an emergency. When as it is necessary for the security and safety of the citizens and other persons from the running of cars and trains come to Shelby St, Hancock St., North St. and North Main St. when the same is intersected by the tracks of the Chicago, Indianapolis and Louisville Railway Company that a lamp or light be kept and maintained at said crossings. Therefore
Section 1.
Be it ordained by the Board of Trustees of the Town of Broad Ripple, Marion County, State of Indiana that the Chicago, Indianapolis and Louisville Railway Company be and it is hereby required according to the provision hereinafter stated to provide each and maintain a Kitson post lamp or light No. one hundred and sixty five (165) at the intersection of its tracks with Shelby St, Hancock St., North St. and North Main St. of said Town.
Section 2.
Said lamp or lights shall be Kitson post lamps or lights No. one hundred and sixty five (165) of not less than two thousand nominal candle power. And shall be supplied by the said company with a sufficient supply of oil to produce a light of not less than two thousand nominal candle power. And they shall be placed on posts not less than nine (9) feet from the ground and they shall be lighted and burning and shall be so kept lighted and burning from Six (6) oclock PM until Six (6) oclock AM during the months from Oct 1st to Apr 1st inclusive of each year. And from Seven (7) oclock PM until Four (4) oclock AM during the months from Apr 1st to Oct 1st inclusive of each year.
Section 3.
If said Railway Company shall fail or neglect to keep and maintain said lamps or lights as herein before provided it shall forfeit and pay to said Town of Broad Ripple any sum not exceeding twenty ($20.00) dollars for each night wherein it neglects to provide such lamp or light as herein provided.
Section 4.
Whereas an emergency exists for the immediate taking effect of this ordinance, the same shall be in full force and effect after its passage.
