CONTINUED PETITIONS:

2006-UV1-016 6310 North College Avenue (Approximate Address), Request(s): VARIANCE OF USE of the Dwelling Districts Zoning Ordinance to provide for the construction of a 50-foot tall, three-story structure with five condominium units on the upper floors and parking on the lower floor (not permitted, maximum height of 35 feet permitted), with a seventeen-foot front setback (minimum 40- foot front setback required), with a one -foot north side setback (minimum four - foot side setback required), resulting in a 6.33-foot side yard aggregate (minimum sixteen-foot side yard aggregate required), with a ten-foot rear yard setback (minimum twenty-foot rear yard setback required), with a floor area ratio of 1.9 (maximum floor area ratio of 0.350 permitted), and an open space ratio of 0.27 (minimum open space ratio of 2.100 permitted), and a livability space ratio of 0.038 (minimum livability space ratio of 1.2500 permitted), and a major livability space ratio of 0 (minimum major livability space ratio of 0.140 permitted).

2006-APP-851 5401, 5411 AND 5425 NORTH COLLEGE AVENUE (Approximate Address) KRG COLLEGE, LLC, by Thomas Michael Quinn requests Approval of MODIFICATION OF COMMITMENTS, related to petition 2005-ZON-811, to a) modify Commitment One to read as follows: "The site plan and elevations, file dated October 5, 2006 shall be substantially complied with, including at least five parking spaces having dimensions of ten (10') by eighteen (18') feet, and b) modify Commitment Twelve to read as follows: "Additional landscaping shall be in compliance with the site plan file dated October 5, 2006. Final landscaping plans shall be submitted to the approval of the Administrator. VARIANCE OF DEVELOPMENT STANDARDS of the Commercial Zoning Ordinance to provide for:
a) an overall building height of 35 feet without providing an additional one-foot setback for each foot in height over eighteen feet along the north and east transitional property lines (not permitted),
b) an interior drive aisle and loading space with a zero-foot setback in therequired two-foot east side transitional yard (not permitted, two-foot east side transitional yard permitted by petition 2006-VAR-811),
c) an unenclosed loading space without the required screening or maneuvering area (screening required, proper maneuvering area required).

NOTE: descriptions in parenthesis such as, "not permitted" and "minimum ... required", are describing the current zoning for the property. The variance is being sought to deviate from those limitations.
