Old Town of Broad Ripple Meeting Minutes #199

This historic serial has run on and off in the last 18 years of the Broad Ripple Gazette. The intention is to share the history of Broad Ripple, help people find their ancestors in the text, and to complete the transcriptions of these important early documents.
The Town of Broad Ripple was incorporated in 1894, and started holding regular meetings at that time. In each issue, I will print my transcription of the old Town of Broad Ripple meeting minutes. These are taken from the original, hand-written minutes that contain many spelling errors. I have transcribed all the records as they were entered, including errors. I will make some corrections to the text in brackets [ ]. I will try to include street name changes, such as: Shelby Street became 63rd, then Broad Ripple Avenue, Morgan Street is now Guilford, North is now 64th, Hancock is now Westfield. Bond Ordinance #3

An ordinance providing for the issuance of bonds for the improvement of east side of Morgan St. from Shelby St to 60th Street in the Town of Broad Ripple, Marion County, State of Indiana and declaring an emergency

Whereas the final estimate and report of the Town Engineer upon the improvement of east side of Morgan St. from Shelby St to 60th Street in the Town of Broad Ripple, Marion County, State of Indiana shows that there is due thereon to J.M. Lackey, the contractor five hundred thirty four and 01/100 dollars, and
Whereas this Board of Trustees adopted and approved said estimate and report on the 8th day of August 1904 and
Whereas it appears that the following named persons owners of the lots situated within this town set opposite their names herein given each lot or tract assessed respectively with the amount specified below have each sign and filed with the clerk of this town a written agreement promising and agreeing in consideration of their right to pay their respective assessments in annual installments, to waive all objections to any irregularity or illegality to such assessments. To wit: -

Making a total of $534.90, therefore

Sec 1
Be it resolved by the board of Trustees of the Town of Broad Ripple. Marion County, State of Indiana, that for the purpose of anticipating the collection of said assessments, improvement bonds be issued to the amount of $534.90 by this Town for the purpose of raising money with which to pay for said improvements. Said bonds shall bear the following statements. "East side of Morgan Street {to} from Shelby Street to 60th St.". and shall be payable as follows: ten per cent thereof on the first Monday in November, 1904, and ten percent on the first Monday in November of each year thereafter, until the whole is paid with interest at five per cent per annum upon the unpaid part thereof, payable semi-annually upon the first Monday of May and the first Monday of November of each year until all is paid.

Sec 2.
Said bonds shall be issued in the name of the Town of Broad Ripple, signed by the Board of Trustees, and Town Clerk, and sealed with the corporate seal of said Town, but the signature of said Board of Trustees and Town Clerk to the coupons may be lithographed or placed on with a stencil or stamp instead of being written and shall bear date of November 3rd, 1904, and numbered 7 to 13 inclusive

Sec. 3
Whereas an emergency exists for the immediate taking effect of these resolutions, therefore the same shall be in full force and effect from and after their passage.
Resolution accepting waiver and agreement of landowners along the line of the improvement of Hamilton Street in the Town of Broad Ripple, Indiana and declaring an emergency

Whereas the following persons respectively owning the lots, tracts, and parcels of land situated in the Town of Broad Ripple and State of Indiana set opposite their names. Viz:-

Which was assessed by the Board of Trustees on the 8th day of August 1904 for the improvement of Hamilton Street from Shelby Street to Coil Street on the west side of said Street in the amounts respectively set opposite each above described lot, tract or parcel of land: and

Whereas the owners of said lots, tracts, and parcels of land have each respectively filed with the clerk of said town a written release of any illegality or irregularity in said assessments in consideration of the privilege of paying said assessments in ten annual installments in accordance with the provisions of an act of the general assembly approved March 8th 1889 and the amendments thereof and supplementary thereto and agreeing to pay the amounts respectively assessed to each of them with interest thereon at the rate of five percent per annum as shall by ordinance or resolution of this Board of Trustees be prescribed or required. Therefore

Be it resolved that said agreements are hereby accepted and the clerk of this town is hereby directed to place upon the city tax duplicate said assessments as above enumerated and charge against said several lots, parcels or tracts of land as follows to wit.

Ten percent for each successive year for ten years to which several amounts shall be added and placed on the duplicate interest at five percent per annum payable semi-annually which shall be collected from the 8th day of August, 1904, until the several allowances fall due.
Whereas an emergency exists for the immediate taking effect of this resolution the same shall be in full force and effect from and after its passage
